The present legal warning and information (hereinafter “Legal Notice”) governs the use of the service of the Internet Web Site www.nvginternacional.com (hereinafter “NVG Internacional”) which NVG Internacional (hereinafter “the company”) has made available for Internet users.

The company has its registered office in "C/ Arlanzón 5, 1ºB, 37185 Villamayor (Salamanca - España)”, and holds F.I.N B37464179. The use of the company grants the condition of user of the company (hereinafter, “user”), and implies the complete and unconditional acceptance of each and all of the dispositions included in this Legal Notice in its version published by the company at the same moment that the Users access the Gateway. As a consequence, the User must read carefully the present Legal Notice every time he intends to use the company as the former may undergo modifications.

The use of certain services offered to the Users through the company may be subject to its own and specific conditions (hereinafter “the special conditions”) which, depending of the cases, substitute, complete and/or modify the present Legal Notice. Therefore, before the use of such services, the User will also have to read carefully the relevant Specific Conditions.

1.- Object.

The company is a Web Site which offers Internet users, access to information through all the pages that compose it, access to contents and news directly in their pages or through links to other free access addresses in the net.

2.- Conditions of use.

2.a.- This Web Site may contain materials elaborated by NVG Internacional with a view to inform about the services offered. Such materials reflect the current state of the services offered. Therefore, when contracting a service, the user accepts that the conditions of this service are those published at that particular moment in www.nvginternacinal.com and not those which may have been published previously or may be published in the future. In addition, the company commits itself to not vary such conditions without informing its clients. Should such variation represent a benefit for its clients, the variation will be applied to the contract signed with the client (unless explicit notice on the contrary)

2.b.- The links contained in this Web Site and which redirect the user to other Web Sites managed by third parties in which NVG Internacional does not exercise any other type of control; NVG Internacional will not respond neither of the contents nor of the state of such Sites and will not recommend or approve its contents.

2.c.- www.nvginternacional.com as free communication platform according to the Laws of the Spanish State, will not be liable for the opinions and contents showed which have not been directly produced by www.nvginternacional.com

3.- Limit of liability.

NVG Internacional does not guarantee the absence of virus or other prejudicial elements which may cause damage or alterations to the informatic system, to the electronic documents or to the files of the user in this Web Site. Therefore, www.nvginternacional.com will not be liable for the damages and prejudices which may lead to interferences, omissions, interruptions, informatic virus, telephone averages or disconnections in the operation of this electronic system as a consequence of reasons beyond the control of www.nvginternacional.com regarding delays or blockage in the use of the present electronic system caused by deficiencies or surcharges of the telephone lines or surcharges in the Internet system or in other electronic systems, as well as damages which may be caused by third parties through trespass beyond the control of www.nvginternacional.com.

4.- Intellectual property rights.

4.a.- All contents of this Web Site, both texts, images, sounds, files, brands, logos, color combinations or any other element, their structure or design, the selection and presentation of the materials included in it and the computer programs required for its operation, access and use are protected by the intellectual and industrial property rights owned by the company or if applicable, by its licensor and the user of this Web Site will have to respect them.
 
In addition, all commercial names, brands or distinctive marks of any kind contained in the Web page www.nvginternacional.com are protected by Law.

4.b.- The user recognizes that the intellectual property rights of the Web Pages, their graphic design and codes belong to the company unless different ownership is mentioned therein. The non authorized reproduction, distribution, marketing or transformation of such works, except for personal and private use, represents a violation of the intellectual property rights of www.nvginternacional.com or of the holder of the same. These exploitation actions may only be performed with the previous express authorization of www.nvginternacional.com and as long as it makes explicit reference to the ownership of www.nvginternacional.com of the above mentioned intellectual property rights.

5.- Data protection.

5.a.- According to what has been foreseen in the Organic Law 15/1999, the user of this Web Site has been expressly informed of the incorporation of its details to the existing files in www.nvginternacional.com and consents that the company performs the treatment of their personal data which are expressed in the present conditions and which derive from the same, with the purpose of performing its appropriate development, fulfillment and control until their total cancellation. Moreover, the company has been authorized to use such data for commercial purposes being their beneficiaries, commercial and technical services of the company and being able to send the user commercial information regarding their products and services. The user also accepts that their data are transferred to other entities belonging to NVG Internacional, to participated companies or to others with which www.nvginternacional.com has signed collaboration agreements with commercial purposes with a view to keep the user informed of any assets or services which they either directly or indirectly market at present or in the future. 

5.b.- In any case, the User will be entitled to request and obtain information regarding his personal details included in their automatic files and if applicable, to rectify and cancel such details, in the form foreseen in the already mentioned law. The department in charge of the file will be that of the Data Base of NVG Internacional. Such rights may be exercised by the user or if applicable, by anyone who presents a signed written request sent to the following address: “C/ Arlanzón 5, 1ºB, 37185 Villamayor (Salamanca - España)". The request may contain the following information: name and surname of the user, address to the effects of notices, photocopy of Identity Card or Passport and specific content of the exercised right.

5.c.- The company will keep the personal data which it may have collected and will adopt the necessary measures to avoid their non authorized alteration, loss, treatment or access. The company will fulfill these duties according to the dispositions of the applicable rule.

Model of the consent clause for the automatic treatment of personal data:
